Terms of Service

By accessing the website and services of C'MON Hot Shot Delivery Services LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our website or services.

These Terms apply to all visitors, users, and clients of our website and delivery services. We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.

C'MON Hot Shot Delivery Services LLC provides hot shot trucking and delivery services including but not limited to:

• Hot shot delivery of oilfield equipment and supplies
• Construction material transport and delivery
• General freight hauling (local and regional)
• Emergency and time-critical deliveries
• Vehicle transport services
• Warehouse and distribution center deliveries

All services are provided in compliance with FMCSA regulations. We are authorized for interstate commerce under USDOT 4411856 | MC 1733234.

• Quotes: All quotes provided are estimates valid for 14 days unless otherwise specified in writing. Rates may vary based on fuel surcharges, distance, weight, and special handling requirements.
• Deposits: A deposit of 30% may be required for large or specialized shipments to secure scheduling.
• Payment Terms: Full payment is due within 15 days of delivery unless alternative terms are agreed upon in your service agreement.
• Accepted Methods: We accept major credit cards, bank transfers, certified checks, and ACH payments.
• Late Payments: A 2% monthly interest charge will be applied to outstanding balances beyond the agreed payment terms.

• 48+ Hours Notice: Full refund minus any administrative fees.
• 24-48 Hours Notice: 50% of the quoted delivery fee will be charged to cover dispatch and scheduling costs.
• Less Than 24 Hours Notice: Full delivery fee applies.
• No-Show: Full delivery fee applies with no refund.

Cancellations must be communicated via phone or email. Rescheduling is subject to availability and may incur additional fees.

C'MON Hot Shot Delivery maintains comprehensive cargo and general liability insurance. However:

• Our liability for loss or damage to cargo is limited to $100,000 per shipment unless higher coverage is requested and purchased at the time of booking.
• We are not liable for indirect, incidental, consequential, or punitive damages.
• We are not responsible for delays caused by circumstances beyond our reasonable control, including weather, road conditions, government actions, or force majeure events.
• Clients are responsible for properly packaging and securing cargo unless loading services are specifically requested and provided.

C'MON Hot Shot Delivery maintains the following insurance coverage:

• Commercial Auto Liability Insurance
• Cargo Insurance (up to $100,000 per load)
• Commercial General Liability Insurance
• Workers' Compensation Insurance

Clients may request additional insured endorsements or higher cargo coverage limits for an additional fee. Certificates of insurance are available upon request.

Any disputes arising from these Terms or our services shall be resolved as follows:

• Informal Resolution: Parties shall first attempt to resolve disputes through good-faith negotiation.
• Mediation: If informal resolution fails, parties agree to submit to non-binding mediation before pursuing other remedies.
• Governing Law: These Terms are governed by the laws of the State of Texas.
• Jurisdiction: Any legal proceedings shall be brought in Denton County, Texas.
